Diego Quilodran Volleyball Performance
Booking Terms
Diego Quilodran Volleyball Performance Draft updated: 29 September 2026 Provider: Diego Quilodran, independent volleyball coach, Auckland, New Zealand Bookings, privacy requests and complaints: diego.quilodran.nz@gmail.com Phone: +64 29 022 04745
1. About these terms
These terms govern volleyball coaching booked directly with Diego Quilodran, including individual and group training, beach or indoor coaching, assessments, trial preparation, video analysis and prepaid packages. They apply whether a booking is made by message, form, invoice or booking website. If a separate written proposal for a school, club or event conflicts with these terms, that proposal takes precedence for the stated service. Diego provides the coaching himself or through a specifically agreed substitute; he is the service provider, not a booking marketplace.
The customer is the person or organisation responsible for the booking and payment; the player is each participant. An adult who books for a child confirms they are a parent or legal guardian or have authority to book and provide the necessary information. A booking becomes binding when Diego confirms its details and payment is received or an alternative payment arrangement is confirmed in writing. The version of these terms supplied before that booking applies to it.
2. Services, availability and suitability
The booking confirmation states the type of service, date, start time, duration, location, number of players, fee, included equipment and any separately agreed venue or administration charge. All times are Auckland local time. Coaching methods are adapted to the player's age, experience and needs. Diego will exercise reasonable care and skill, but cannot promise a particular improvement, team selection, scholarship or competition result. An assessment or video analysis provides coaching feedback, not medical diagnosis or treatment.
Diego may decline a requested booking if the service or venue cannot reasonably be provided safely, if the player needs specialist supervision outside the service offered, or if essential information or payment has not been provided. Any money received for an unaccepted booking will be refunded.
3. Booking accounts and communications
If an online booking account is available, the customer must provide accurate contact, player and emergency details, keep login credentials private and promptly report suspected unauthorised access. Booking messages may be sent through email, text or the booking system using the details supplied. Diego may keep necessary booking communications to manage the service, payment, complaints and safeguarding. Marketing emails, if offered, require a separate choice and must provide a way to unsubscribe. A minor's guardian will normally be included in direct booking and welfare communications.
An online booking or payment provider may have its own account, payment and privacy conditions, which will be linked at checkout. Diego will identify any third-party fee before the customer pays. A failed payment means the booking is not confirmed unless Diego agrees otherwise in writing. Diego does not store full card details when a payment processor handles them.
4. Prices, payment and taxes
The total price in New Zealand dollars, duration and any additional venue, processing, operational or administration fee will be itemised before confirmation and payment. Operational and administration work may include reasonable time spent finding a suitable gym, checking availability, coordinating with the venue and arranging its booking. The confirmation will state whether this work is included in the coaching price or carries a separate agreed fixed fee; no unaccepted fee will be added later. A separately charged amount and the work it covers must be reasonable and transparent. Searching for a gym does not guarantee availability: if Diego cannot secure a venue he undertook to provide and no suitable alternative is agreed, the customer will receive a refund for the undelivered service and associated administration. An advertised price applies to the stated service only. GST, if applicable, will be treated and shown as required by law. Diego may change advertised prices for future bookings; an accepted booking will not be repriced without the customer's agreement.
Payment is due before training unless an invoice or written agreement provides another due date. The customer remains responsible for agreed fees for the booked players, including a group member's absence. If an invoice becomes overdue, Diego will send a reminder and may pause future sessions after giving reasonable notice; this does not remove any legal rights or an existing entitlement to a refund.
5. Venue, equipment and weather
The confirmation will say who arranges and pays for the court. Diego will obtain agreement before charging any venue hire. If the customer agrees to provide a venue, they must secure permission and make it available at the agreed time; if it becomes unavailable, both sides will seek a reasonable alternative. If that cannot be arranged, the customer cancellation provisions apply only to Diego's actual reasonable loss, taking account of saved costs and any replacement booking. If Diego undertakes to provide the venue and cannot do so, the customer may choose a suitable alternative without extra cost or a refund for the affected service.
Players must wear appropriate footwear and clothing and bring water and any equipment specified in the confirmation. Diego may change the activity, move an outdoor session with agreement, or stop training because of unsafe weather, court conditions or facility closure. Where the session cannot be provided, Diego will offer a reasonable new time or a refund for the service not delivered; venue charges will be dealt with fairly according to who booked the venue, amounts recoverable and applicable consumer rights. Neither party must train in conditions reasonably considered unsafe.
6. Customer cancellation, rescheduling and no-shows
The customer should notify Diego through the booking contact above. Notice is measured from the original session start time in Auckland, including weekends and public holidays. A reschedule is effective only when Diego confirms a new time; the time of the customer's first request determines which notice band applies if no new time is agreed.
| Notice | Coaching and operational/administration fees | Agreed venue charges |
|---|---|---|
| At least 48 hours | Full refund of the coaching fee. If operational/administration work was charged separately, Diego may retain only a reasonable, previously disclosed and agreed amount for work already completed; the balance is refunded. The customer may instead choose a reschedule without another charge for completed administration that can be reused. | Only separately disclosed, actually incurred and unrecoverable venue charges may be deducted, with an explanation. |
| Less than 48 hours | Diego will make reasonable efforts to fill the slot or agree on another date. He may charge up to 80% of the agreed total price for coaching and administration, including gym search and coordination already performed and reasonable administration time directly caused by the cancellation. The 80% is a ceiling, not an automatic fee: the amount must reflect a reasonable estimate of loss caused by the cancellation, after deducting avoided costs, work not performed and income from a replacement booking. The same administration work will not be charged twice. Any excess paid will be refunded. | In addition, only reasonable venue costs disclosed and agreed in advance, actually incurred and unrecoverable may be charged. Those costs will not be counted again in calculating the loss subject to the 80% ceiling. |
| No-show | The same short-notice rule applies. Diego will wait up to 15 minutes and try the booking contact. | The same rule applies. |
Before payment, the booking summary will prominently show the 80% ceiling and any separate administration or venue charges. Diego can explain how a deduction was calculated on request. If a player arrives late, training normally ends at its original finishing time; the agreed fee generally applies. Diego may extend the session if available without promising an extension. Tell Diego promptly about sudden illness, injury or emergencies so that he can consider a fair alternative. A cancellation charge does not apply to a service Diego fails to provide or where the customer has a legal remedy for a service failure.
7. Cancellation or changes by Diego
If Diego cancels before training, the customer may choose a full refund of the affected booking, including a venue charge collected by Diego, or a new suitable time at no extra charge. Diego will give as much notice as reasonably possible. If a coach-related problem interrupts a session, Diego will offer an appropriate partial refund or make-up time for the portion not delivered, subject to any stronger legal remedy. A substitute coach will be proposed only with advance disclosure and the customer's agreement; declining a substitute entitles the customer to the same refund or reschedule choice.
8. Prepaid packages
The advertised 10-session 1:1 package is NZ$800 for ten 60-minute private coaching sessions when offered at that price. Unless a different term is disclosed before payment, the booking period is six months from purchase. Diego will provide reasonable appointment options during that period. If Diego cannot reasonably offer the outstanding sessions, he will extend the period or refund those sessions. For a significant injury, illness or other exceptional circumstance, the customer may request a reasonable extension or refund of undelivered sessions.
For an early cancellation at the customer's request, completed sessions are counted at the package rate of NZ$80 per session; reasonable, previously disclosed and unrecoverable costs may also be deducted, and the balance is refunded. A booked package session cancelled late is assessed under section 6 using that session’s package value (NZ$80 in the package described), plus any separate administration fee accepted before the booking. Only the amount of the reasonable applicable charge will be deducted from the package; if it is less than one session’s value, the balance remains as credit. Administration already included in the package price will not be charged twice. Package sessions belong to the named player unless transfer is agreed. Package discounts do not remove statutory consumer remedies. Other packages will state their session length, price, validity and refund method before purchase.
9. Player information, safety and responsibility
Players or guardians should provide the information reasonably needed to train safely, including relevant injuries, limitations, emergency contact details and any accommodation they request. They should update this information and report pain or illness during a session. Diego will take reasonable steps to provide a safe coaching environment, explain relevant exercises and adapt or stop activity when appropriate. Players must follow reasonable safety directions and avoid conduct that endangers themselves or others.
Sport involves a possibility of injury even when reasonable precautions are taken. Each player is responsible for telling Diego when an activity feels unsafe for them; this acknowledgment does not waive Diego's duty of care or the customer's legal rights. Diego may call emergency services if reasonably needed and will contact the nominated guardian or emergency contact. Any emergency services or treatment costs are governed by the provider's rules and applicable law, not automatically assumed by Diego or the customer under these terms.
10. Children and safeguarding
A guardian must authorise bookings for players under 18, give a reachable emergency contact, and agree on drop-off, pickup and any permitted independent travel. Diego's scheduled supervision starts and ends at the confirmed session times, but if a guardian is unexpectedly late he will take reasonable safeguarding steps, contact the guardian or emergency contact, and avoid leaving the child alone. A child may decline an activity or image capture that makes them uncomfortable. Diego will use appropriate professional boundaries and respond to safeguarding concerns promptly. Venue or school safeguarding requirements apply when training there.
For a group, the person booking cannot give publicity permission on behalf of other players or guardians without their actual authority; Diego must obtain the relevant permissions for identifiable participants before publishing images. If a session is arranged through a school or club, its safeguarding, visitor and filming rules also apply.
11. Behaviour and ending a session
Customers, guardians, players and Diego must act respectfully. Diego may pause or end a session for serious or repeated unsafe, abusive, threatening or discriminatory conduct, after reasonable steps to resolve the issue where safe to do so. The financial outcome will reflect the service delivered, reasonable loss, the cause of the problem and applicable law. Diego may decline future bookings for a reasonable safety or conduct concern and will refund any prepaid future services he will not provide, subject only to reasonable lawful deductions directly arising from the customer's breach.
12. Photography, video and use of image
Diego may ask to photograph or film sessions. Booking a session does not authorise promotional use. A separate, optional permission permits use of identifiable image, voice or approved testimonial in posts and reels, the business website, social media, presentations, digital and printed flyers and other publications promoting Diego Quilodran Volleyball Performance. Images may be cropped or edited for those purposes without misleadingly changing their meaning. Diego will not sell the player's image or give another business independent advertising rights without further permission.
For a minor, a guardian must provide promotional permission and Diego will respect the player's objection. The player or guardian may withdraw permission at any time through the booking contact. Diego will stop new use and remove content from channels he controls where reasonably practicable; printed material and copies already downloaded, shared or held by other services may not be retractable. Permission will be checked again periodically for ongoing use involving minors. Diego will avoid publishing a child's full name, school or contact details with an image without further specific permission. Group images will be reviewed to avoid identifiable people without permission. School and venue filming rules take priority.
Optional private video for technical feedback is a different permission. Unless separately agreed, it may be shared only with the named player or guardian and is not licensed for public promotion. Refusal of either image permission does not affect access to coaching.
13. Privacy and records
Diego collects contact, booking, payment status, relevant health and emergency information, communications and images authorised for their stated purposes. He uses this information to provide coaching, manage bookings and payments, respond to safety incidents, comply with legal obligations and, where separately agreed, publish promotional content. Information is kept reasonably secure and shared only with relevant booking, payment, venue or emergency providers where needed, with consent, or as permitted or required by law. A third-party service may process information under its own disclosed privacy terms.
Contact Diego to request access to or correction of personal information, raise a privacy concern or withdraw optional image permission. Diego will consider deletion requests, subject to legitimate retention needs such as tax records or incident handling. Health details and children's records will be accessed only when reasonably needed. If a fuller privacy statement is published for a booking website, it will explain the actual systems and retention practices in use; it will not override these terms or the Privacy Act 2020.
14. Content and intellectual property
Diego's training plans, written resources and original coaching videos remain his or their respective owner's intellectual property. A paying customer may use material supplied for the named player's personal development and may not sell, publish or redistribute it without permission. A player who supplies their own image or video confirms they have the right to share it for the agreed coaching purpose; supplying content does not itself grant Diego promotional rights. Use of another person's image, school logo or club branding requires the relevant permission.
15. Insurance, liability and legal rights
Diego does not represent that a customer's belongings, travel or personal accident costs are covered by insurance supplied through the booking. Customers may consider their own cover. Diego is responsible for performing his services with reasonable care and skill. Nothing here excludes liability that cannot lawfully be excluded, including consumer guarantees, or prevents a customer seeking remedies for a breach of those guarantees. Diego is not responsible for a player's personal items unless loss is caused by his failure to meet a legal obligation. No blanket waiver, automatic indemnity or fixed cap on Diego's liability is imposed by these terms.
16. Concerns and disputes
Please contact Diego with the booking date, issue and outcome sought. He will acknowledge a complaint within five working days and aim to propose a response within ten working days, or explain if more time is needed. The parties will first try to resolve the matter directly and in good faith. This does not restrict either party from seeking independent advice, making a complaint to an appropriate authority or using the Disputes Tribunal or courts where available. No compulsory arbitration applies.
17. Third-party sites, schools and clubs
Links to external sites and the use of independent venues do not make those parties part of Diego's coaching agreement. Their separate rules may govern their own facilities and transactions. If Diego acts as a coach for a school, club or another organisation rather than taking the booking directly, that organisation's agreement and policies may govern that activity; customers will be told who supplies the service and collects payment. References to a school, club or sporting body are not endorsements unless expressly authorised.
18. Updates, governing law and general terms
Changes to these terms apply to future bookings after the revised version is made available. An existing confirmed booking changes only by agreement, except where law requires otherwise. These terms are governed by New Zealand law. If any provision is unenforceable, the remaining provisions continue where possible. A delay in enforcing a right does not itself waive it. Notices from Diego will go to the booking contact given by the customer; notices to Diego should go to the business email above.
